1. Scope
These terms and conditions apply to every booking, visit, gift voucher order and private dining or event at Ember. By booking or ordering, you accept these terms.
Ember is operated by:
- Ember BV
- Registered office: Guldenstraat 9, 2800 Mechelen, Belgium
- Company and VAT number: BE 0783.363.090
- Email: hello@embermechelen.be
Deviations from these terms apply only if we confirm them in writing.
2. Bookings, deposit and cancellation
A booking is confirmed once you receive the confirmation email and the deposit of €25 per person has been paid. The deposit is fully deducted from your bill on the day of your visit.
| Situation | Effect on the deposit |
|---|---|
| Cancellation more than 24 hours before the booking | Fully refunded |
| Cancellation within 24 hours of the booking | Not refunded |
| Fewer guests, notified more than 24 hours in advance | Refunded for the cancelled guests |
| Fewer guests, notified within 24 hours | Not refunded for the missing guests |
| No-show | Not refunded |
| Cancellation by Ember (force majeure, closure) | Fully refunded, or moved to a new date at your request |
You can cancel or change your booking via the link in your confirmation email, by email or by phone. The time we receive your message is what counts.
We hold your table for 15 minutes after the booked time. If you arrive later without letting us know, we may give the table to other guests and this counts as a no-show. As our menu is served in a single seating, late arrival may also mean we have to shorten the menu.
The 14-day right of withdrawal does not apply to restaurant services provided on a specific date (Article VI.53, 12° of the Belgian Code of Economic Law).
3. Groups, private dining and events
Groups of 7 or more cannot book online: please send your request by email to hello@embermechelen.be. For private dining and events, we prepare a tailored quote. A private dining or event booking is confirmed once the quote is signed and the advance payment stated in it has been made.
Please confirm the final number of guests no later than 5 working days in advance. That number is the minimum we invoice. Cancellation is governed by the terms in the quote; if the quote says nothing, the advance payment is non-refundable for cancellations within 14 days of the event.
4. Menu, prices, allergies and your visit
Menu. We serve a set tasting menu that changes with the seasons and what our suppliers offer. Dishes shown on the website are indicative; we may change them without prior notice.
Prices. All prices are in euro, including VAT. The price that applies when you book is the price you pay, unless you order extras during your visit.
Allergies and dietary needs. Please tell us about allergies, intolerances and dietary needs when booking, and no later than 48 hours before your visit. We do our best to adapt our menu, but cannot guarantee that a dish is completely free of traces of allergens. Allergies not reported in advance may not be accommodated on the evening itself.
Your visit. We ask you to be considerate of other guests. Ember may refuse entry or end a visit in case of inappropriate behaviour, without refund.
Own wine. Bringing your own drinks is not permitted unless we confirm it in writing in advance. In that case we charge a corkage fee of €40 per bottle.
5. Gift vouchers
Gift vouchers are valid for 1 year from the date of purchase, as stated on the voucher. They cannot be exchanged for cash or extended after expiry. A voucher for a set amount can be used over several visits; a voucher for a specific menu applies to that menu.
Book with a gift voucher like any other booking and mention the voucher code. The cancellation rules in section 2 apply to that booking.
If you buy a gift voucher online, you may withdraw from the purchase free of charge within 14 days, as long as the voucher has not been used. To do so, send an email to hello@embermechelen.be. We refund you within 14 days. Ember is not liable for lost or stolen vouchers.
6. Liability, complaints and governing law
Liability. Ember is not liable for loss, theft or damage to personal belongings, including in the cloakroom, except in case of intent or gross negligence on our part. Our liability is in any case limited to the amount of your bill, except for personal injury or where the law prohibits such a limitation. Guests are liable for any damage they cause to the interior or equipment.
Force majeure. If force majeure (fire, power failure, government measures, illness of the chef) prevents us from honouring a booking, we refund the deposit in full or move your booking by mutual agreement. No further compensation is due.
Complaints. If something is not right, please tell us during your visit so we can address it straight away. Afterwards, you can email us at hello@embermechelen.be. If we cannot resolve it together, you can contact the Belgian Consumer Mediation Service (consumentenombudsdienst.be).
Governing law. These terms are governed by Belgian law. Disputes are submitted to the courts of the judicial district of Antwerp, without prejudice to mandatory rules allowing consumers to bring proceedings before the court of their place of residence.
Language. These terms are also available in Dutch. In case of discrepancy, the Dutch version prevails.
Privacy. How we handle your personal data is explained in our privacy policy.
